Solid Waste Facility Permitting

Prepare Solid Waste Facility Permit Application for a Biosolids Facility

Justice & Associates was retained by EnerTech Environmental to prepare the permit application for a regional biosolids handling/processing facility located in Southern California. EnerTech’s SlurryCarbTM process converts biosolids (sludge from municipal wastewater treatment plants) into a moderate-energy renewable solid fuel (E-Fuel). At the time of permitting, there were no other facilities in the United States performing the SlurryCarbTM process. Justice & Associates was required to interpret Federal Regulations 40 CFR Part 503 which regulates beneficial use of domestic sewage sludge and 40 CFR Part 501 which requires states to implement federal regulations concerning sewage sludge and determine applicable permit requirements and facility standards. Based on these findings, it was determined that the combined California Integrated Waste Management Board (CIWMB) and State Water Resources Control Board (SWRCB) Title 27 Solid Waste regulations were applicable and required a full Solid Waste Permit.
The SlurryCarbTM process is a newly developed and unique process. A SlurryCarbTM facility has never been constructed in the United States. As a result, consistency of the regulations regarding permits for the Enertech facility was unclear and the agency coordination was a barrier because they have little experience working with this type of facility. Justice & Associates assisted in all aspects of obtaining the permit, including documentation preparation to secure funding for the construction of the project. Justice & Associates coordinated and prepared documents required demonstrating compliance with California Statute AB 939 requiring diversion of Municipal Solid Waste from landfills.
