| Experience and Qualifications | Tom has over thirty-five years of experience with the Construction Materials Industry including fourteen with Vulcan Materials Company, Western Division (formerly CalMat Co.). While with Vulcan Materials Company, Tom was Director of California Permitting. The Resource Management Department managed by Tom was responsible for land use and environmental entitlement, permit compliance, assisted in acquisition due diligence and governmental/community relations. Tom holds a bachelor’s degree with dual majors in Biology and Geology from Cornell College as well as a Master of Science Degree in Environmental Studies from Cal State Fullerton. Tom is recognized throughout the State of California as an expert in land use entitlement. Tom has successfully permitted over 250 million tons of aggregate reserves in San Diego, Orange, Riverside, and Ventura counties, California. He has successfully negotiated several real estate transactions including purchase and sales agreements, leases, licenses, and easements. Tom was formerly on the Executive Committee of the California Mining Association and is currently a member of the California and Industrial Construction Materials Association Environmental Committee as well as a member of the NSSGA Mining and Reclamation Committee. Previously, Tom has served as the chairman of National Aggregate Association (NAA) Wetlands Task Force Committee where he offered expert testimony before the White House Interagency Wetlands Task Force hearing in Anchorage, Alaska. Tom has also served as chairman of the National Ready Mixed Concrete Association’s Storm Water Run-off Task Force, as well as a member of NAA’s Public Relations and Governmental Affairs Committees. |

| Noteworthy Projects | Tom recently served as principle-in-charge of a mine expansion in the Coachella Valley near Indio. The project term was successful by adding 90 million tons of permitted reserves and adding 30 years (50 years total) to the permit term. Hanson Aggregates (and its predecessors) have operated on a 100 acre parcel of land in Orange, CA since the 1920s. In 2002, the City of Orange informed Hanson that the pavement recycling business wasn’t a permitted use in the Sand & Gravel zone. Tom was retained by Hanson to advocate a reversal on the City’s position which was accomplished at the City Council level. During his tenure at Justice & Associates, Tom has served as an expert witness in six litigations. The issues dealt with the condemnation of aggregate bearing land, disputes between landlord and operator and Federal mining policy. |

| Experience and Qualifications | Robert has over 40 years of environmental regulatory experience, including an Environmental Science Degree from Grand Canyon University in Phoenix, Arizona. Prior to entering the environmental field Mr. Evans spent 5 years with Arizona Public Service Company working in design and construction of power distribution systems. In 2005 Robert retired from a 37 year career with Maricopa County Air Quality Department (MCAQD), including 13 years as Department Director. During his years with MCAQD Robert's experience was extensive. He worked in permitting, compliance, enforcement, air monitoring, and source testing. As Department Director, Robert served as a registered lobbyist at the Arizona State Legislature assisting in developing air quality laws that preserve Arizona resident's quality of life, protect the states environment, and promote economic development. As a consultant, Robert has assisted numerous businesses and industries throughout Arizona comply with multi-disciplinary environmental regulatory provisions, including air, water, MSHA, mine reclamation, water rights, and floodplain mineral extraction. |

Jennifer graduated with a Bachelor of Science degree in Marine Biology with a minor in Chemistry from California State University, Long Beach. Her coursework provided a thorough background of the life sciences with an emphasis in environmental impacts. In addition, she is a Registered Environmental Assessor in California and a Certified Environmental Manager in Nevada. Since joining Justice & Associates in 2002, Jennifer has worked on various projects to ensure our client's conformance with environmental regulations and deadlines. These projects include, but are not limited to: Storm Water Pollution Prevention Plans, Spill Prevention, Control and Countermeasure Plans, Phase I Environmental Site Assessments in accordance with American Society for Testing Materials (ASTM) E-1527 Standards, Groundwater Monitoring Plans, Operation Plans for Inert Debris Engineered Fill Operations, Hazardous Waste Management & Contingency Plan's, Hazardous Waste Minimization (SB-14) Plans, Conditional Use Permit Applications, and Hazardous Material Business Plans, Emission Inventory Reports and Toxic Release Inventory (TRI). In 2007, Jennifer opened the Northern California office, but continues to assist clients throughout California, Nevada and Arizona. Jennifer has been certified to evaluate visible emissions in accordance with EPA Method 9 which will aid her in keeping Justice & Associates' clients in compliance with Federal New Source Performance Standards. In addition, she has been certified as an Underground Storage Tank Designated Operator in accordance with Title 23 of the California Code of Regulations. Experience and Qualifications |
Craig Foo is a chemical engineering and economics dual degree graduate from Lehigh University, Bethlehem, PA. Craig has over four years of experience in the environmental engineering and consulting industry with emphasis in air, water, waste regulations, and emission credits trading market. He is responsible for South Coast Air Quality Management District (SCAQMD) Regional Clean Air Incentives Market (RECLAIM) facilities that Justice & Associates manages including transmitting emissions, providing support for RECLAIM audits, and peer review of emissions calculations. Craig's other responsibilities include preparing air pollution emissions evaluations and engineering support data for air pollution permits. Craig currently manages the Annual Emissions Report (AER) portfolio for over 40 companies located throughout the SCAQMD jurisdiction. He is responsible for the emission calculations as well as performing peer review of the AER calculations. In addition to the AER portfolio he manages, he is also responsible for Environmental Protection Agency's (EPA) Toxic Release Inventory Report for over 20 facilities located throughout California and Arizona. Craig was the key engineer responsible for the specific compliance and permitting SCAQMD requirements for the Los Angeles County Museum of Art expansion project. His responsibilities for this project included SCAQMD Rule 1166 Compliance Plan support and National Pollutant Discharge Elimination System (NPDES) permitting and engineering evaluation. In addition to his air quality experience, Craig is also a SCAQMD Rule 2202 certified employee transportation coordinator. Since his certification, he has completed employee commute surveys for companies located throughout the SCAQMD jurisdiction. Craig assisted various companies, including FORTUNE 500 companies, in saving over $1,000,000 worth of emission credits based on his emission calculations during SCAQMD's moratorium on issuance of certain air permits. During the SCAQMD's moratorium, he developed cost effective solutions for clients based on their operational requirements and SCAQMD rules and regulations. As an emission credits broker, Craig has brokered multiple Emission Reduction Credits (ERCs) trades throughout the California, especially within the SCAQMD jurisdiction. In addition, Craig has brokered SCAQMD's RECLAIM oxides of nitrogen (NOx) trades for over 20 companies in Southern California. In addition to his air permitting experience, Craig has performed multiple Phase 1 Environmental Site Assessment (P1 ESA) in accordance with the American Society for Testing and Materials (ASTM) E-1527 standard. He has performed P1 ESA's on various properties including urban in-fills and rural farm land properties. Craig was also involved in performing due diligence engineering evaluations by providing property condition assessment and wet utility assessment reports for various housing communities in California and a 15-property manufactured home community throughout Florida. Craig prepared storm water pollution prevention plans (SWPPP) and storm water annual reports for various industrial facilities throughout Southern California. His responsibilities include permitting and compliance with California's State Water Resources Control Board (SWRCB) storm water discharge requirements as well as recommending and implementing Best Management Practices (BMP's) for his clients. |

Experience and Qualifications |
Kathy has over 20 years of experience in the environmental engineering field. She received her Bachelor of Science from the University of Michigan in 1986 and her Master of Science from Rutgers University in 1989. Her experience includes preparation of Federal, State and Local water quality, hazardous waste and air quality compliance reports, plans and permit applications. She also performs environmental compliance audits and site assessments. Industries requiring these services include auto manufacturers, airline maintenance facilities, gasoline stations, aerospace, printing, textiles and construction materials. She is also California Registered Environmental Assessor (REA-03516) and a Certified Professional in Storm Water Quality (CPSWQ - 0515) through Envirocert International Inc. Prior to joining Justice & Associates, Kathy worked in the refining and aerospace electronics industries and ultimately became a consultant providing a wide range of regulatory services. Since joining Justice & Associates in 2000 she has focused on environmental compliance audits, site assessments, and water quality control regulations. Kathy has extensive experience in the construction materials and construction/demolition contractor arena. She has been responsible for providing guidance and insight for leaking underground storage tanks, Phase I Site Assessments, Spill Plans, Waste Water and Storm Water Control Plans as well as preparation of periodic regulatory reports. Kathy was lead consultant in applying for and obtaining the solid waste facility permit from the California Integrated Waste Management Board for the first biosolids processing facility in the United States. Due to the sensitive biological areas at Santa Catalina Island, some Storm Water dischargers must obtain special permit exceptions. Utilizing her background in the sciences in combination with her regulatory experience, Kathy is managing the permit exception process for stakeholders on Catalina Island. She has performed extensive research, prepared sampling plans and protocols, coordinated sampling activities, prepared reports and performed as liaison to the regulatory agencies. |

Susan Justice has extensive experience in bookkeeping, accounting and computer related business activities. She has a masters degree from Oakland University and has industry-related experience including construction contracting and estimating, long distance telephone service, consulting on starting and running small businesses, accounting and air dispersion modeling. She is responsible for the financial health of the business, overseeing all banking, accounts payable and accounts receivable activities. Susan manages the health insurance, 401K pension and profit sharing programs as well as all other employee benefit programs. She also maintains a close working relationship with our bank manager and negotiates and controls all lines of credit and business accounts. |

| Noteworthy Projects | Susan distinguished herself and helped set the stage for the Justice & Associates consulting business several years ago when she invested in an early version of the EPA Air Dispersion Model. At that time the EPA Model was designed for a main frame computer utilizing the old IBM punch card data input system. Susan reformatted the data into PC language and successfully ran the program to verify compliance with the SCAQMD New Source Review Regulation XIII.
After learning the EPA Air Dispersion Model "inside out", she enrolled in several classes where she became proficient in running several other models. Models prepared by Susan have undergone extensive review and evaluation by meteorologists from the South Coast AQMD and Ventura APCD and in all cases have been approved as submitted. This early venture into providing air dispersion modeling consulting became the seeds for forming the business activity known today as Justice & Associates. |

| Noteworthy Projects | A radio facility
in Glendale, CA, needed to replace a 100-foot high antenna with
a 140-foot high antenna, located on a parcel zoned for
residential use with a height limit of 35 feet. A Conditional
Use Permit was necessary to allow a commercial radio
transmission facility in a residential zone. Furthermore, the
City required a Variance due to the height of the structure.
Valerie streamlined both applications as one project, which was
approved by the Zoning Administrator in one Public Hearing. An industrial plant located in Rialto, CA, needed to build a pipe to transport brine water between two facilities. The pipe crossed properties owned by four different government agencies, each requiring a different process to allow for the pipe to be built. Valerie secured the necessary encroachment permits and easements for all affected parcels. The project also necessitated a new storm water outlet for one of the facilities, which in turn required permission by the U.S. Army Corps of Engineers, the Santa Ana Regional Water Quality Control Board, the California Department of Fish and Game, and the U.S. Fish and Wildlife Service. Valerie was able to secure permission from all involved agencies, which allowed for construction to be completed before a construction ban due to bird nesting took effect. Valerie also performs monthly Underground Storage Tank Inspections for multiple facilities and is responsible for monthly, quarterly, and annual storm water documentation of nearly 50 facilities. |

Tien graduated from California State University Fullerton, where she majored in Computer Information Systems. Tien is experienced in DataBase Design, Systems Design and is a Website Developer and Programmer. Over the past ten years, she has undertaken a variety of roles in database management and web development for Justice & Associates. Some of her accomplishments at Justice & Associates includes setting up the interactive Emission Credits Exchange Trading website and assisting our clients in California and Nevada with their environmental management systems software. Tien has planned, developed, and implemented numerous applications using a combination of hand-coding and development tools in Visual Basic, SQL, Access, ASP, Java, HTML, CSS and JavaScript. She establishes and maintains site infrastructure, has built intuitive user interfaces, created and compressed graphics and other media, designed databases, researched content for site design and marketing strategies. |

Susana Perez is a graduate of California State Polytechnic University, Pomona where she majored in Civil Engineering. With over 12 years of air quality permitting experience she has permitted facilities in South Coast Air Quality Management District (SCAQMD), San Diego Air Pollution Control District (SDAPCD), Santa Barbara Air Pollution Control District (SBAPCD), Ventura County Air Pollution Control District (VCAPCD), Bay Area Air Quality Management District (BAAQMD), Great Basin Unified Air Pollution Control District (GBUAPCD), Kern County Air Pollution Control District (KAPCD), Mojave Desert Air Quality Management District (MDAQMD), Antelope Valley Air Quality Management District (AVAQMD) Sacramento Metropolitan Air Quality Management District (SMAQMD) and Clark County Department of Air Quality and Environmental Management (DAQEM). Susana has established herself as an expert in auditing facilities to assess compliance with EPA’s New Source Performance Standards which apply to Non-Metallic Mineral Processing and Hot Mix Asphalt Production (40 CFR Subpart OOO and Subpart I). She has also become proficient in preparation of SARA Title III reporting and Community Right To Know requirements. Susana has been involved in Air Quality Modeling involving criteria air pollutants and toxic air contaminants for various projects. Susana has prepared several Air Quality Impact Analyses for projects as they relate to the California Environmental Quality Act (CEQA). She has conducted air quality peer review for County agencies as part of the CEQA process. She has prepared Diesel Particulate Health Risk Assessment (HRA) evaluations relative to air quality impact analysis. |

Experience and Qualifications |
John attended the University of Nevada, Reno where he studied Public Relations and Speech Communications. His course work has aided him in the ability to present subject matter to large and diverse crowds. John has made presentations to groups such as, the Engineering and Utilities Contractors Association (EUCA), the California Construction Industry and Mining Association (CalCIMA), The Associated General Contractors of California, The California Rental Association, The Asphalt Pavers Association, and the Oregon Logging Conference. Spending 14 years in the rock, sand and gravel industry, he learned all the aspects of the mining process. While working for RMC Lonestar, RMC Pacific Materials and finally CEMEX, Inc. John was the plant manager in the Livermore Valley and was in charge of all mining, reclamation and maintenance activities for two significant aggregate plants. Mining on average, 4.5 million tons of raw material each year between the two plants. With over 40 pieces of heavy duty diesel equipment to aide in the mining process, he quickly learned what it took to keep the fleet in operation. After leaving CEMEX, John went to work for Peterson Tractor Company in San Leandro, CA as the Emissions Solutions Specialist. During his time with Peterson, he was able to gain a vast knowledge of the Caterpillar equipment line. With this knowledge and his previous experience, John was able to work with contractors and heavy equipment operators in regards to the California In-Use Off-Road Diesel Regulation. Through group presentations and one on one meetings he has helped the equipment operators to comply with the diesel regulations. Working closely with the local Air Districts and the California Air Resource Board, John has successfully acquired funding through Carl Moyer, CAPCOA, and Multi-District Funding for the contractors and heavy equipment operators. |

Experience and Qualifications |
Kimba Spencer, a graduate of California State University, Long Beach, has been with Justice & Associates since 1998. She formerly headed up the Emission Credits Exchange where she evaluated consumption trends relating to future allocations. During her stint as credit trader, she brokered the single largest trade ($7,000,000) in the RECLAIM market during the year 2000. Kimba was also in charge of our Third Party Transmitting service, electronically reporting emissions to the South Coast AQMD. Kimba brokered well over a hundred ERC and RTC trades with dozens of companies. Kimba has been instrumental in the research, preparation, and follow-up of our off-road machinery repower and retrofit applications for Carl Moyer, SCAQMD AQIP, and SOON grant funds resulting in awards of over 100 million dollars for our clients. She has participated in RECLAIM administration and electronic reporting since 1999. Currently she conducts peer review of our third-party electronic transmitting and prepares the record-keeping for our ACEMS (Automated Continuous Emissions Monitoring Service) clients. Kimba has become the company go-to person for AutoCAD projects including flow diagrams, site plans, and vicinity maps. She has also become accomplished in AutoCAD add-on Civil 3D, using it to prepare detailed mine and reclamation plans for large scale projects that include proposed slope grading, cross sections, and volume calculations. Kimba has been trained and certified as an ICC Certified Designated Operator for underground storage tanks. She has also been certified as a portable analyzer operator under South Coast AQMD 1146 Regulation. Kimba has successfully prepared air permit applications for operations in air districts throughout California for equipment including, but not limited to, aggregate plants, asphalt plants, boilers, spray booths, storage tanks, engines, and furnaces. She also provides consulting and registration application preparation for the Statewide Portable Equipment Program (PERP) as well as notifications and emission calculations for off-shore PERP projects. She has prepared Storm Water Pollution Prevention Plans, Storm Water Annual Reports, Conditional Use Permit applications, Spill prevention, Control, and Countermeasure plans and Emission Inventory Reports. She has also conducted fugitive dust analyses and reports. |

An Engineering graduate from Cal Poly Pomona, Scott Taylor has over 13 years of experience in assisting companies in industries such as hot mix asphalt, aggregate crushing, sand drying, and cinder block manufacturing. His work in these industries has involved air districts throughout California, Arizona and New Mexico. He has established himself as an expert in Southern California on the RECLAIM rules covering compliance of facilities located in the South Coast AQMD. He has participated in a team that has installed several Alternative Continuous Emissions Monitoring Systems (ACEMS) on Hot Mix Asphalt plants that are a part of the RECLAIM program. He is frequently called on to manage compliance audits for RECLAIM Facilities and is known for his ability to quickly sort out compliance issues. Scott has received training and has performed air dispersion modeling for a variety of projects including showing compliance with NSR thresholds and to perform Health Risk Assessments for Toxics. Facilities rely on him for coordinating and evaluating source tests at their facilities. Often these tests are looking to show initial compliance and or comply with permit conditions. He has received the SCAQMD Certification as an Air Permitting Professional and has an open and friendly working relationship with many Air District personnel. |

| Noteworthy Projects | Blue Diamond Materials purchased a new portable hot mix asphalt facility and wanted to have permits for the same facility in 6 different air districts. Scott was responsible for coordinating the permitting of the facility and interfacing with the district to achieve resolution to stumbling blocks during the processing of the application. Some of the air districts had not permitted a hot mix asphalt plant in over 8 years. These air districts were unfamiliar with how to evaluate a new hot mix asphalt plant to meet the more stringent emission requirements. In all cases, Blue Diamond received permits on schedule and with production that exceeded their requirements. | |
